Terms of Use
These terms of use govern your use of the Farium macOS application and the farium.eu website. They are governed by German law.
1. Scope
These terms of use ("Terms") apply to the Farium macOS application ("the App") and to the website at farium.eu ("the Website"), both operated by DGAL Projectmanagement & Consulting GmbH ("we", "us", "our"). By downloading, installing, or using the App, or by using the Website, you accept these Terms.
The App is provided free of charge to both consumers and business users.
2. License
The App is provided free of charge for private as well as professional and commercial use on macOS. We grant you a simple, non-exclusive, non-transferable, and revocable right to install and use the App on as many Macs as you own or are responsible for.
The following are not permitted:
- Reverse engineering, decompiling, or disassembling the App, except where exceptionally permitted under § 69e UrhG (German Copyright Act) or other mandatory statutory provisions
- Removing or altering copyright notices
- Redistributing the App as your own product
- Sublicensing, renting, or selling the App
3. Warranty
Since the App is provided free of charge, warranty is governed by §§ 516 et seq. BGB (German law of gifts). Accordingly, we are only liable for defects we have fraudulently concealed. In all other respects, the liability provisions in Section 4 apply.
You are solely responsible for creating backup copies of your work. The App stores your files as plain .md files on your local storage device.
4. Limitation of Liability
We are liable without limitation for intent and gross negligence, for damages resulting from injury to life, body, or health, under the Product Liability Act, and within the scope of any guarantees we have assumed.
For damages caused by slight negligence, we are liable only in the event of a breach of essential contractual obligations (cardinal obligations), the fulfillment of which makes the proper performance of the contract possible in the first place and on whose observance you may regularly rely. In such cases, liability is limited to damages typical of the contract and reasonably foreseeable.
In all other respects, liability for slight negligence is excluded, in particular for lost profits, indirect damages, consequential damages, and loss of data.
The foregoing limitations of liability also apply for the benefit of our corporate bodies, employees, and the agents and vicarious agents engaged by us.
5. Intellectual Property
The App, the Website, the name "Farium", the Farium logo, and all related design elements are protected by copyright and other intellectual property laws. All rights not expressly granted to you in these Terms are reserved.
Open-source components used within the App are subject to their respective licenses. A list of these components and their licenses can be found within the App under Help → About.
6. User-Generated Content
All content you create using the App (your notes, documents, and files) belongs to you. We have no access to it and claim no rights over this content. The App stores everything exclusively on your local device.
When you use the contact form on the Website, you grant us the right to read, store, and respond to your message for the purpose of processing your inquiry. For details, please refer to our Privacy Policy.
7. Changes to These Terms
We may amend these Terms from time to time. Material changes will be announced via the Website and, where applicable, via the App. Continued use of the App or the Website after changes take effect constitutes acceptance of the new Terms.
8. Termination
You may discontinue use of the App and uninstall it at any time. We may terminate your right to use the App if you materially breach these Terms and fail to remedy the breach without delay. The provisions on intellectual property, warranty, liability, and applicable law shall survive termination.
9. Governing Law and Jurisdiction
These Terms are governed by the law of the Federal Republic of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG). The exclusive place of jurisdiction for all disputes arising from or in connection with these Terms is Halle (Saale), Germany, provided you are a merchant, a legal entity under public law, or a public-law special fund.
Mandatory consumer protection provisions under the law of your country of residence remain unaffected.
10. Severability
Should any provision of these Terms be invalid or unenforceable, that provision shall be limited or rescinded to the extent necessary for the remaining Terms to otherwise remain effective.
